Who we are

Shila Dorai Raj

Shila was the founding CEO of the Malaysia Competition Commission (MYCC) from June 2011 to December 2014.  She was responsible for setting up the MyCC as well as laying the foundation for implementation of the Competition Act 2010 which came into effect on 1 January 2012.  She was named in the top 100 women who have excelled in the field of anti-trust in the world by the Global Competition Review in 2014.  During her tenure as the CEO of MyCC, she oversaw MyCC's first key competition law infringement decisions including the MAS-Air Asia case.

 

Prior to her appointment as CEO, Shila was instrumental in drafting the Fair Trade Practices Policy for Malaysia which later was modified to become the nation's Competition Policy.  She was also the head of the drafting team for Malaysia's Competition Act 2010.

 

She has worked extensively with ASEAN Member Countries and was the chair of the ASEAN Experts Group on Competition 2008.  She has presented, moderated and chaired several conferences and meetings both in international and domestic arenas and has written various articles and papers on compeition law issues.  Currently, she is engaged in providing advisory services on competition law to several ASEAN Member States as well as conducting training on competition law and competition law compliance.

Dr C. W. Cheah

Dr Cheah is an expert on competition economics who has in depth experience with market definition and competition analysis.  Since 2006, he has been involved with case investigations, testified before and arbitration tribunal and advised regulatory authorities (in Australia, NZ, Singapore and Malaysia) on the formulation and application of rule-of-reason tests.

 

In the period between November 2012 and July 2014, he was retained by the Malaysia Competition Commission (MyCC) to advise on and assist with, the competition analysis in case investigation, in addition to providing advocacy presentations and in-house training.

 

He is the author of "The Broiler Market Review", which was the first market review conducted by MyCC pursuant to section 11 of the Competition Act 2010.

Rachel Burgess

Rachel has specialised in competition law in Australia, the UK and Malaysia for more than 15 years, working for both private practice and government. She has advised a wide spectrum of clients, ranging from government Ministers, senior civil servants and military personnel, to senior company lawyers and board directors, commercial managers and their staff.  Much of Rachel's work in private practice involved implementing tailored competition law training and compliance programmes.  Rachel also has extensive experience training clients on dawn raid procedures and establishing robust dawn raid processes.

 

Rachel worked as a consultant to the Malaysia Competition Commission (MyCC) during its early years, assisting with staff training, drafting MyCC publications including the Handbook for Business, Compliance Guidelines and FAQs for SMEs, providing expert advice in ongoing investigations and speaking on behalf of the MyCC at advocacy events.
